Shields: I Accuse! An Open Letter to Congress

Sarah Shields writes in a guest op-ed for IC:

I accuse you, the US Congress, of having voted for US House Resolution 34 by an overwhelming margin, 390-5. In the name of protecting Israel’s security, this Resolution instead protects Israel’s “right” to hold a whole population accountable for the violations of a few. By condoning Israel’s behavior over the past two weeks as self-defense, HR 34 condemns one and a half million Gazans to capital punishment without trial for crimes they have not committed. By publicly acknowledging and approving Israel’s behavior, you now share responsibility for the outcomes.

I accuse you of having the blood of hundreds of innocent children on your hands. I accuse you of the death of Shahd Abu Halemeh, an infant of 18 months, whose corpse was found badly burned in the wreckage of Gaza. I accuse you of the deaths of the four Salha children, Rola (1), Baha (4), Rana (12), and Dyia (14), who died when the Israelis dropped a missile on their house. I accuse you of the deaths of those killed while seeking refuge from constant bombardment, people who sought protection at a school run by the United Nations. Despite the clear UN markings and flags, Israelis attacked the sanctuary, killing 30 and wounding 50. And I hold you responsible for the lives of the 252 other children killed in the first sixteen days of Israel’s attack on Gaza, and the deaths of those who will be killed as a result of your encouragement.

I accuse you of violating the laws made by the Congress of the United States, laws like the Arms Export Control Act of 1976, which insist that American-made weapons may not be used against civilian populations.

I accuse you of supporting flagrant violations of human rights. The combatants you voted to support are required by international law to care for civilian victims of war. Yet the Israeli government denied the International Committee of the Red Cross access to the sites they bombed for four days. The nightmares that resulted are too horrific to be imagined. Perhaps you could contemplate what the ICRC found when it was finally allowed to provide relief for the victims of Israeli bombing: four children, so starved that they could not stand up, huddled by their dead mothers. Food and water have become hard to find, and medicine is vanishing as the need for medical care explodes as more and more missiles land in Gaza. Israel has, nonetheless, targeted not only a UN school, but also a UN convoy bringing desperately needed supplies. The result, according to the ICRC’s director of operations, is catastrophic. "There is no doubt in my mind,” he stated, “that we are dealing with a full blown and major crisis in humanitarian terms. The situation for the people in Gaza is extreme and traumatic as a result of ten days of uninterrupted fighting. In that sense, their situation has clearly become intolerable."

I accuse you of transgressing international law. The United States, as one of the High Contracting Parties to the Fourth Geneva Convention, is required to protect civilians in war, and to call to account anyone who targets them. You have instead voted to support behavior considered criminal according to international law.

I accuse you of making our ally, Israel, less secure than ever before, as the orphans of today seek vengeance in the future. Instead of seeking a real peace, a peace of mutual security and prosperity, you have chosen to support only one side in this ongoing struggle, condemning the others to enormous suffering.

I accuse you of putting politics before humanity, of condoning the slaughter of innocents, of supporting war crimes instead of standing up for the most basic human right: the right to live without the terrifying fear of immediate death.

I hold you responsible, each of these 390 members of America’s 111th Congress. I accuse you of complicity in the most serious transgressions that humans can commit.

Did Israel attempt every possible way to protect itself from the rockets and to stop the rockets before deciding to inflict a crushing attack on Gaza? History will condemn what Israel is doing. But why can't we condemn it now? It's our American weapons and diplomatic support at the UN that makes it possible.

In spite of the arrival of the Dems the US still holds the same biased discourse toward Israel.

I wish that there were more voices like that of Sarah Shields coming from the States, but America seems to be a hopeless case in matters of International humanitarian laws. We (Europeans) don't share the same value as America anymore.

We were used to the US love for the law of the jungle in economic matters. But after 8 years of Bush domination, the US has also adopted the law of the strongest in matters of politics and international relations. And what this vote shows is that the arrival of Obama and of the Dems didn't change anything (or not much).

America has become an alien for us.

A courageous piece. To which I would add the charge of rejecting negotiations with other elected representatives, even when proven to stop the very rocket fire they profess to care about.
One may or may not like Hamas. In similar circumstances the African National Congress wasn't perfect either. But it remains that Hamas (a) entered the democratic process and won, (b) have a record of observing ceasefires and agreements generally, and (c) have repeatedly offered recognition of Israel in the longer term.

A message to Barak "no comment" Obama, from Bill and Kathleen Christison
Your unwillingness before inauguration to say anything substantive about Gaza in public is in our opinion a tragic error. Specifically, your failure to censure Israel for refusing to accept immediately the U.N.’s ceasefire resolution on Gaza will severely and very rapidly damage the true U.S. national interest of improving our relationships throughout the Islamic world.

Over the longer run, it will also damage our relationships with much of the rest of the world, which sees us as the financier and enabler of Israeli actions in Gaza that are irrational and immoral and that will, over time, harm Israel’s own long-term interests. Perhaps most important of all, your own actions, or inactions, have encouraged the entire right wing of Israeli politics and that part of the Israel lobby in the U.S. that is dominated by the conservative, elderly (and generally wealthy) leaders of AIPAC.

These groups – that is, the people who actually determine Israeli policies today – are the ones whom your actions have encouraged to *intensify* current Israeli military activities in Gaza. That makes you personally responsible for any killings of either Palestinians or Israelis that occur between now and your inauguration.

You might call this the blowback of your own policies toward Israel.

Well written with an appropriate tone of moral outrage. Israel is behaving like an unhinged mad-man. Its actions are not its own best interest. Shame on those U.S. congress members that tacitly support such slaughter and counterproductive policies. I’d like to see the haters on both sides go away, but Israel’s actions will only spur them on and multiply their numbers. Where has Jewish wisdom gone?

Keith Ellison, my Rep and the only Muslim in congress voted present rather than no.

Looking at the roll call, I'd argue there's still a long way to go before progressives have enough influence to produce a stronger protest vote.

Where's the drama? Why should this matter? We're in the awards season and the football postseason right now so we Americans have a lot TV to watch.

Just like the FISA vote last summer, this vote shows that we (and by 'we' I mean progressives) haven't moved the ball on civil liberties or key areas of foreign policy.

It just dawned on me the other day, after I read Juan's post about a new PAC.

US and Euro democracies are going to do NOTHING for justice and peace, as long as their interests do not apply. Let's just accept that and stop getting agitated over it.

The only way to do anything is grassroots. Juans PAC article was a good start. We have to take things in our hands, and stop looking at govs. I am working now in that direction, and I hope everyone else does too.

The sad reality is the US cannot anymore say anything to Israel. The facts are, the US has done similar atrocities in Irak. I find what happened in FalluJha is almost a copycat of what Israel is doing right now.
I suspect that Israel state has a long list of things the US did in Irak and other places. Both US and Israel are mirror images when it comes to human rights and waving war whenever they want.

I just wish that Obama will change this, giving back some kind of morality the US has lost globally for 8 years now.

One sees both Gazans and Israelis so doing.
Professor Cole seems better able to apportion responsibility.

I'm sending this to my NH representatives today. My fellow Democrats and I were thrilled when Shea-Porter and Hodes beat the Republican incumbents in 2006 and won re-election in 2008. I'm bitterly disappointed that both voted yea on this atrocity

The cease fire was proving to be the most effective way yet for Israel to protect itself from the rockets (by stopping them) until the Israelis apparently got tired of it and broke it. For the 4.5 months the cease fire held there was a 99% reduction in rockets fired, and no injuries or deaths.

But do we really believe this carnage is about rocket fire? Do we really believe the 2006 33 day horror in Lebanon was about "kidnapped" (sic) soldiers?

Dear Sarah Shields,

God Bless you. You reminded me that there are still good human beings around.

The problem in the American media nowdays is the ease with which to brand other human being to the degree of allowing killing without enough thinking or trying to know the roots of the problem. Also, making people victim in a massive scale for the action of a few.

It is time that the American people get to know the causes of problems in order we solve them instead of causing death.

With regard to the current situation in Gaza, Israel wants to kill any aspirations for the Palestinian people to have an independent state. Also, Israel wants to make life hell for them in order they leave and eventually Israel annexes the remaining lands.

This is downright comical. To the poster who wrote that Hamas has a history of "generally" observing cease fires, you must be on drugs. Cease-fire means exactly that, cease firing...as in STOP. Not reduce, not lessen, STOP. The fact that rockets continued to be launched only shows that Hamas is not a true democratic gov. because they don't control their own military. See, when you shoot rockets indiscriminately at people for 8 years, their government is going to be upset. Most governments probably wouldn't allow for the opportunity of a cease fire. They would just react militarily. What the bleeding heart liberals fail to realize in this conflict is that is one VERY important distinction regarding the mindset of these two parties in conflict, the people of one party dance in the street and celebrate when innocent people of the other party are killed. Thats the one thing Arabs can never understand, don't expect Westerners to believe that extremism is a problem among a select few Arabs when hundreds of thousands of people rally around heartwarming events like 9/11, the release of Samir Kuntar, and the slaughter of innocent Israelis. You don't see Israeli's dancing around Tel-Aviv buring Palestinian flags everytime a Palestinian is killed, and many even politically side with the Palestinians, where is this populace on the other side.

Alexander, you might want to take a look at this study before telling someone he must be on drugs.

"Cease-fire means exactly that, cease firing...as in STOP. Not reduce, not lessen, STOP."

And before shooting off your mouth again, you might also want to take a look at this study from the right wing Israeli Intelligence and Terrorism Information Center. You can download and study all 47 pages of it if you like. Here are a few items from the report that you might want to think about. Bear in mind that Fatah is the party whom Israel and the U.S. have chosen to back:

"the calm was disrupted by sporadic rocket and mortar shell fire and occasionally
by light arms fire and attempts to place IEDs by rogue terrorist organizations (primarily networks
of Fatah, the Popular Resistance Committees and other small groups, some of them affiliated
with Al-Qaeda)

"Hamas, for its part, was careful to maintain the ceasefire."

"Networks belonging to Fatah/Al-Aqsa Martyrs Brigades were the most prominent and
central in violating the lull arrangement.

"During the first period Hamas was careful to maintain the ceasefire and its operatives
were not involved in rocket attacks

" [The "first period" refers to the period prior to November 4-5 when Israel launched a major, unprovoked attack on Gaza, in which they killed seven Palestinians. During the first week of this period Israel fired into Gaza multiple times per day, then calmed down after that. Hamas did not retaliate during this period.]

Ummmmm - they don't HAVE a military. Israel does not ALLOW them to have a military (and apparently Israel doesn't even want them to have traffic police, since on December 27 they bombed a police cadet graduation ceremony, killing tens of cadets, who were just 19 and 20 year old kids who were just trying to find an honest way to earn a living). And according to the report quoted above, which comes from a right wing Israeli think tank, Hamas kept the ceasefire, and did a creditable job of reining in other groups who were not parties to the ceasefire.

"See, when you shoot rockets indiscriminately at people for 8 years, their government is going to be upset."

Which prompts the question as to why their government did not get sufficiently upset to launch a prolonged, murderous attack until after Hamas succeeded in sustaining a 99% reduction in rocket fire for 4.5 months, and only resumed firing rockets AFTER Israel launched a major attack on November 4.

So, why didn't they? Why did they wait to attack until there had been 4.5 months of a successful ceasefire during which the residents of Sderot were able to begin to live normal lives? Why did they choose to put their citizens in danger again by breaking the ceasefire themselves instead of working with Hamas to successfully complete the first six months, and then negotiate a renewal? One almost has to wonder whether they really cared about the safety and security of their own citizens.
