Police Crackdowns on OWS Coordinated among Mayors, FBI, DHS

Oakland Mayor Jean Quan let slip in an interview with the BBC that she had been on a conference call with the mayors of 18 cities about how to deal with the Occupy Wall Street movement. That is, municipal authorities appear to have been conspiring to deprive Americans of their first amendment rights to freedom of assembly and freedom to petition the government for redress of grievances.

Likewise, A Homeland Security official let it slip in a phone interview that the FBI and the Department of Homeland Security had been strategizing with cities on how to shut down OWS protests. The FBI is said to have advised using zoning ordinances and curfew regulations, and to stage the crackdown with massive police force at a time when the press was not around to cover the crackdown.

Wonkette suggests that the PATRIOT Act is implicated here, but I’m not sure how that works. Actually the techniques discussed are standard for US police forces in dealing with peaceful protests (the only routine technique missing is that of putting saboteurs among the protesters who cause destruction and create an image of them as violent.

What these two reports show is a high-level conspiracy to deprive Americans of their constitutional right to protest peacefully.

When will we see Occupy Wall Street protesters hooded, dressed in orange jump suits, and sent to Guantanamo for military trials? When you let the government act without regard for the rule of law toward foreigners suspected of terrorism, you open yourself to be treated the same way if the rich decide to sic their police on you (it is mostly their police). This is why a rule of law has to be maintained. Anything less ratchets toward tyranny.

    Here’s my full comment of yesterday which is worth a read and may encourage many of you to action or at least to share it with others, especially changing the election laws and processes, perhaps one of the only ways we can change our corrupted government and protect our future.

    Possible killing blows were struck upon the Occupy Wall Street movements in many America cities this last weekend when mayors closed down parks and areas of OWS occupation with their police illegally arresting and attacking non-violent protesters.

    Were these individual actions part of a planned coordinated action by the mayors, the “powers that be” and other higher authorities to kill the OWS movement?

    It appears that the lack of a specific goal is resulting in the growth of individual groups with more focus, some on aggression. You must realize that many of the “powers that be” want to shut down the OWS movement. For them to seed the OWS with “trouble makers” is not hard to believe. Add this to the negative publicity, the cold weather and that many homeless and street people are mixing in with the OWS protesters to take advantage of the OWS services, food and supplies resulting in some minor clashes which discourages or turns away many serious OWS supporters and gives the mayors excuses for police actions.

    Will the combination of the mayors aggressive, illegal actions of closure with the above observations result in a temporary or more serious halt of the OWS movement?

    Are we going to see any more massive OWS weekend marches and protests which are the blood and strength of the OWS movement that keeps it alive and strong?

    My own conclusion and action consists of bringing to the attention of all OWS supporters and of the 99% of Americans what I believe should be their immediate prime goal that addresses all their individual goals:

    Change election laws and processes so that both multiple parties and candidates can run and be elected in 2012.

    America must replace the corrupt Republicans and Democrats with politicians that will represent the 99% of Americans.

    Is it too late? Gerrymandering and the electoral Congress must be stopped, eliminated.

    Congress would fight these changes.

    Could a united movement by 99% of Americans forced Obama to issue presidential executive orders changing election laws?
    Or would Obama ignore the voice of 99% of Americans?

    Americans must change election laws and processes to save the future of America & the world.

  4. Well of course, Juan. The US Government has been corrupted on all levels for centuries, and do not want any kind of level playing field for anyone. They have been beating the shit out of us and beating us down for decades, much less any other country. This roundup is just another step in their complete consolidation of power for the 1%. I’m sure they will try to slip some kind of Patriot Act BS into this, so they can jail us like they have the rest of the country, but the Patriot Act is coming down peacefully, just like the rest of it, through Democracy. To any readers who do not own a gun, I suggest you get your permit very quickly and practice, practice, practice. For deer season, that is.

  7. Professor Cole, the story about DHS supposedly coordinating the crackdowns on the Occupy movement is dubious. It originates with a single anonymous source, quoted on a website of dubious reputation. I would take it with a grain of salt until further confirmation surfaces.

  8. I think Wonkette pushes it too far to state that a single unnamed govt. official “confirms” anything. But I do think there is some reasonable evidence for coordination–at some level–by DHS and DOJ. And not just coordination, but assistance in the operational phase, as was encountered by Naomi Wolf and described in her Guardian piece. More here:

  10. The Occupation has definitely effected the media narrative for the past month. It makes one wonder who would benefit from removing the movement from view. The coordination making it happen within days using similar tactics around the country is quite impressive and says something about the centicity of the power arrayed against the people.

    If now the Obama Administration’s minions do want to try to override our Constitutionals Rights via using the ‘Patriot Act’, thereby declaring anyone trying to exercise their rights to be a ‘terrorist’, …and treating them as such via stealing all their belongings and arresting them in the middle of the night, we are becoming our worst nightmare, Germany in 1933.

    I am sure there is also case law protecting us from unwarranted search and seizure. Their purchased winter tents were destroyed by slashing from the outside. There were still patients in the medical tent when they did! No care was taken not to injure them. All medical supplies and equipment were confiscated, well thrown into dumpsters too. Shades of Night of the Long Knives, again see Germany 1933.

    Some of the people in Zuccotti Park had their entire worldly possessions stolen by the NYPD. One young man reported all his clothes, tent, sleeping bag .. and 3 years worth of art drawings were thrown into the dumpster right before his eyes.

    Seized too was their 5,000 book library which was fully catalogued online, (see Library Thing) was thrown into a dumpster. Shades of Fahrenheit 451 and Germany 1933! It was being used by locals in the neighborhood because Chancellor Bloomberg is shutting down these ‘dens of radicalism’ for ‘budgetary’ reasons. Some of the children had never held a book!

    Then last night when they were magnanimously allowed to go back to the park it was without adequate clothing, without food and without water. All bags were searched without Warrants! They were not allowed to cover the books they had reaccumulated with a plastic sheet, deemed a ‘tarp’ therefore illegal. Hour by hour the guards changed the rules on the protestors.

  12. Juan, I love you, I really do. But honestly, how is the rule of law not being respected here? Last time I checked zoning regulations and curfews were all reasonable laws. And as we all know the right to free speech is not absolute. “Time, place & manner” are reasonable restrictions on this right. The OWS movement is trying to set up camp in public places and park for an indefinite time as they see fit. OWS is not simply attending rallies or protests, they have literally set up camp and would ideally refuse to move if they were able to. So should the broader public simply give up their to use these public spaces because a special interest group thinks they have a superior right to use it exclusively? That sounds like not respecting the rule of law to me.

  14. Of course the Patriot Act is implicated here, but it is the mayors who should be implicated for Domestic Terrorism.

    So sad to see the FBI involved in this anticonstitutional action. How un-American of them since they took an oath to defend the Constitution, and not to destroy it! Now they too are guilty of Domestic Terrorism and they too should be implicated.

    There is nothing written in the First Amendment about permits, curfews, place, manner, safety and health issues, megaphones, drugs, tents, sleeping bags, generators, backpacks, books, GA’s, teach ins, being naked or saying mean things about the gilded fascist elite. It doesn’t mention the number of people required to be an assembly or even if they must be U.S. citizens.

    The only requirement for a constitutionally lawful assembly is being peaceful.

    The kind of violence being committed by the police under orders of their city administrators is Domestic Terrorism as defined by the U.S. Patriot Act.

    People should start pressing charges against these domestic terrorists. Take their photos, get videos and find witnesses willing to testify. Then go to the DA’s office and demand arrests! Next, go to the FBI, the CIA or even to the U.S.Military and demand the criminals be designated as domestic terrorists. The law is for everyone to use, so use it!

    Under the USA PATRIOT ACT, Section 802 of HR 3162 defines domestic terrorism as activities that:

    1.) “involve acts dangerous to human life”

    2.) “that are a violation of the criminal laws of the United States”

    3.) “appear to be intended to intimidate or coerce a civilian population;” or “to influence the policy of a government by intimidation or coercion”

  15. I do see a difference between trampling on their right to protest and trampling on their right to camp out. I hope they’ll proclaim victory and continue to protest knowing that the encampment wasn’t critical to their message. Mostly, I hope they’re strategizing about how to win the coming elections, whether that means defeating Republicans, winning some Democratic primaries, running third party candidates in the few places that might be productive.

There have been various provocateurs at Zuccotti. Some may be just be politically independent people who want to cause a problem, but the police have clearly infiltrated and there have been occasions where it certainly seems like these are government, whether local or otherwise, provocateurs (for example, pushing for more agression). Of course, it is hard to tell. Furthermore, with regard to Homeland security: the NYPD has been using their counter-terrorism units. This is a fact and I can send you a photo. I don’t know the precise details, but assuming that these units receive some of their funding from DHS then we can say that DHS is at least financially behind this in a verifiable way. As alwasy, thank you for your blog, which I have read daily for many years now.

  20. I believe THE MAIN END GOAL OF THE OWS MOVEMENT is to make the US Government representative of and responsible to the 99% of Americans and not of and to the Rich Billionaire Dictators, Corporations, etc and their puppets.

    Correct me if I wrong, but maybe one of the best actions to start working on this goal is the immediate change of the election laws and processes by presidential executive orders so that Americans can start voting in honest and responsible politicians and a 2012 President representing the 99% of Americans.

    The changes in election laws and processes must make it possible for multiple parties and candidates to be on all Federal, State and local ballots so that Americans can start voting in honest, intelligent candidates and a President that will represent 99% of Americans. The legal education of most politicians enables them to manipulate and tell the best stories or lies. No more slick, lawyer talking, verbose presidential candidates.

    Got a better solution to start the change or corrections to my solution please “reply” them to me so other readers can start giving and supporting solutions. I’m politically ignorant. Thus, excuse my errors and give corrections.

  21. What do the Mayors of Oakland, Berkeley, Denver, San Francisco, Austin, Portland OR, Nashville, St.Louis, Salt Lake City, Albany NY, Philadelphia, Youngstown OH, Burlington VT, Chapel Hill, Seattle, and Boston all have in common???

    They are all DEMOCRATS who are all attacking their respective Occupations in one form or another!

    What does that tell us? That it’s being orchestrated from DC by the Justice Department, which is part of the Executive Branch of the US Government!

    Democrats, from the New Deal, on through the 60s (Chicago ’68), continuing through the 90s (Seattle), up until now, have always been a greater threat to real, revolutionary change.

  23. The media is doing a hatchet job on these kids. My wife, my kids and I went to Occupy Tampa to support the 1st Amendment and to get to know the protesters.

    The depth of the knowledge most of these kids have, far exceeds that of an O’Reilly couch potato, and in some cases we found their knowledge of the way things work, astounding.

    My whole family is extremely knowledgeable and aware of the erosion of civil liberties since 9/11.

    To think my daughter would go to one of these and randomly have her head bashed in by some goon cop, would absolutely infuriate our entire family, aunts, uncles, cousins, brothers, sisters, moms and grandmoms. There would be HELL to pay by these cops.

  25. OWS has got to be a Right Wing/Obama conspiracy. Otherwise how can you explain why so much liberal/progressive energy is being expended defending the “right to occupy”. All that energy is being channeled, by the conspirators, toward the most inconsequential exercise.

    My suggestion is that the squatters all move their asses to Massachusetts and try to convince Elizabeth Warren to challenge Obama in the Democratic primaries. Might raise 100 million for the campaign before the MA cops can don their riot gear.

  26. Jean Quan remarked that she was discussing OOakland w/ other mayors @ the SFGate website. She complained that the OO liasons were the least reasonable in the nation, not difficult to believe to residents of the East Bay who watch our anarchists in action. I can’t link to this because SFGate, the website that the SF Chronicle uses, is horribly organized for back-linking.

    That said, there are still daily demonstrations of dissent in downtown Oakland, people freely congregating and speaking. A non-existing right to camp on public land has been ‘revoked.’

    Also note that, unlike Bloomberg’s NYC, the Oakland eviction was done w/ the press in attendance taking photos, no subrosa nonsense. Mayor Quan learned fr/ the first debacle. The cops behaved.
